Implementation of Supreme Court Judgement on Effective Prevention of Sexual Harassment in the Workplace
In compliance with the Hon’ble Supreme Court’s judgment, the Ministry of Women & Child Development (Mo WCD) has reiterated the importance of implementing the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013 in various organizations across India. This act aims to create a safe and supportive working environment for women by preventing and addressing instances of sexual harassment in both public and private sectors.
The Department of Posts has issued a directive to all postal circles and related divisions, calling for strict compliance with the Act. To ensure this, postal circles are required to provide factual updates on their efforts to implement key provisions of the SH Act, 2013.
Key Areas of Compliance:
- Formation of Internal Complaints Committees (ICCs):
Organizations must confirm whether ICCs have been established in accordance with Section 4 of the SH Act, 2013. The composition of the ICCs should be as per the guidelines set out in the Act, ensuring fairness and transparency. - Public Accessibility of Information:
All organizations must share the contact details, including email addresses and phone numbers, of the designated persons such as the Chairperson and members of the ICC. Additionally, the procedures for filing complaints and other related regulations should be available on the organization’s official website for easy access. - Effective Support for ICC Members:
Immediate steps should be taken to ensure that ICC members are adequately trained and equipped to carry out their responsibilities. This includes guidance on how to conduct inquiries when a complaint is received, thereby ensuring due process. - Regular Awareness Programs:
Workshops, seminars, and awareness programs should be regularly conducted to educate ICC members and employees about the Act, its provisions, and the steps involved in addressing complaints of sexual harassment. Upskilling initiatives for ICC members are also highly encouraged.
Deadline for Submission of Compliance Reports:
All postal circles are required to submit the above details, supported by relevant documents, to the Ministry of Women and Child Development by September 23, 2024.
